Significant Amendments on the Electricity Market Balancing and Settlement Regulation and Electricity Market Consumer Services Regulation

Through the promulgation of the Amending Regulation on Electricity Market Regulation on Consumer Services Regulation and Amending Regulation on Electricity Market Balancing and Settlement Regulation (“Regulations”), published in the Official Gazette dated 20th February 2021 and numbered 31401, significant changes were made in many issues such as power outage and objection to the electricity bill.

The amendments made by the Regulations are summarized below:

  • In the electricity market, the retrospective objection period to the settlement notifications or invoices of the market participants for the billing period has been increased from 6 months to 12 months.
  • In terms of power outage due to the unpaid electricity debts, exceptions were made for martyrs, warriors and disabled veterans, consumers over the age of 65, and subscribers who submitted the health committee report stating that they had disabilities over 40% to the assigned supply company.
  • Due to the unpaid electricity debt on time, it wa arranged that the electricity cuts are not made on national and religious holidays, public holidays, on the previous days of these holidays and on Fridays.
  • The illegal electricity consumption bill will be sent to the consumer by return receipt requested within 3 working days at the latest from the date of detection of illegal electricity. Consumers who are found to consume illegal electricity are obliged to pay the invoiced amount until the due date.
  • In the electricity market, consumers were enabled to establish or terminate contracts through e-Government and corporate communication channels of the related company.
  • At the stage of establishing the contract, the required security deposit was provided to be paid in 2 installments to be reflected in the first 2 bills of the residential consumer.
  • It was regulated that the security deposit is not requested from non-residential consumers who have a direct debiting system agreement with banks.
