Mining Regulation has been Published

Mining Regulation (Regulation) entered into force following its publication in the Official Gazette dated December 11, 2022 and numbered 32040.

Through this regulation, the mining regulation published in the Official Gazette dated September 21, 2017 and numbered 30187 (Previous Regulation) has been abrogated. 

In comparison with the Previous Regulation, the Regulation introduces quite a few changes and new provisions, some of which are outlined below:

  • If the extension request is deemed appropriate, the duration of the licence shall be extended from the expiry date of the licence. Mining activities cannot be carried out in the licence areas where the licence expires.
  • Appointment, Employment, Duties and Responsibilities of the Permanent Supervisor have been regulated.
  • Vegetative soil in the areas where mining activities are carried out shall be kept in a suitable place to be used in rehabilitation works.
  • Royalty transactions have been subjected to procedural changes. In particular, 10% or more share transfers of companies who are party to a royalty agreement is now subject to approval.
  • The licence fee rates and the units to be deposited to the account have been regulated.
