Presidential Decree on the Facilities Engaged in Production Activity Based on Renewable Energy Resources
With the Presidential Decree dated 17.09.2020 and numbered 2949 (“Presidential Decree”) published in the Official Gazette dated 18.09.2020 and numbered 31248, the attached decision regarding the prices, periods and the addition of local contributions to be applied for the facilities engaged in production activity based on renewable energy resources shall be put into effect.
Pursuant to Article 6 and 6 / B of the Law No. 5346 on the Use of Renewable Energy Resources for the Purpose of Generating Electricity ("Law No. 5346"), the procedures and principles for the prices and periods as well as the addition of local contributions to be applied for the production facilities with Renewable Energy Resources (“RES”) Certificate that enter into operation after 31.12.2015, shall be determined by the President.
Pursuant to the aforementioned Presidential Decree, the prices specified in the Schedule I of the Law shall apply until 31.12.2030 for RES certified production license holders subject to the RES Support Mechanism that enter into operation as of 01.01.2021 until 30.06.2021.
Similarly, if the mechanical and / or electro-mechanical parts used in the RES certified production facilities that enter into operation as of 01.01.2021 until 30.06.2021 are manufactured domestically, the electrical energy prices which are being produced in these facilities and given to the transmission or distribution system and specified in Schedule II of the Law shall be added to the prices set forth under Schedule I for a period of five years starting from the date of commissioning of the production facility.
