The Regulation Amending the Ports Regulation

The Regulation Amending the Ports Regulation (Regulation) entered into force through publication in the Official Gazette dated 14.04.2023 and bis numbered 32163. Significant amendments made by the Regulation are summarized below:
- The definition of dangerous cargo is introduced and those that are considered as dangerous cargo are clarified.
- The electronic system where the notifications required to be made to public institutions regarding the berthing and departure of ships are made from a single point is called the Port Single Window System (LTP), and the system where the port authorities control the notifications made through LTP and where the port exit document and the delivery order are issued is called the Port Management Information System (LYBS).
- It is set out that the ship and marine vessel authorities are responsible for ensuring continuity in matters related to the seaworthiness of ships and marine vessels navigating in port administrative areas.
- The port authority has become authorized to impose administrative sanctions on ships and marine vessels that berth to coastal facilities, moor to buoys, anchor to mooring areas without the necessary permission.
- The Regulation also includes the administrative fines ranging from TRY 1,000 to TRY 3,312,913.
