Regulation on Transport Deal Organizer Was Published
The Regulation on Transport Deal Organizer (Regulation) entered into force through its publication in the Official Gazette dated 27.08.2022 and numbered 31936. The Regulation repealed the Freight Forwarders Regulation published in the Official Gazette dated 06.07.2018 and numbered 30470. Some of the novelties by the Regulation are summarized below.
The conditions for holding an authorization certificate such as capital threshold and chamber registration are amended. Regulation states that to ensure the continuity and non-interruption of the service, the persons who hold an authorization certificate shall not refrain from providing the service, except for force majeure event that makes the performance of the service impossible. The Regulation amends the periods, fee and procedure for renewal of the authorization certificate.
In addition, obligation to issue a bill of lading for each transportation by the authorization certificate holder, limitations on the freedom of contract for the transport deal organizer and the notification obligation regarding the change in the partnership status of the authorization certificate holders are introduced. Finally, the definition of consignee is re-stated.
