The Council of State’s (Council) Board of the Unification of Case Laws’ decision numbered 2021/5 E., 2024/2 K. (Decision) was published in the Official Gazette dated 16.04.2025 and numbered 32872.
With the Decision,
- In the event of an increase in the amount in full remedy actions, it was ruled that interest should be awarded from the same date from which interest will be awarded on the amount requested in the lawsuit petition, and interest should be awarded from the same date on the increased amount.
- It was stated that if the starting date of the interest to be applied to the amount requested with the lawsuit petition is deemed valid for the amount requested with the petition to increase the amount, this will contribute to the realization of the freedom to claim rights guaranteed by the Constitution and will be compatible with the right to a fair trial, which is one of the principles that governing the proceedings.
