The Communiqué on Environmental Impact Assessment Qualification Certificate is Published

The Communiqué on Environmental Impact Assessment Qualification Certificate (Communiqué) entered into force following its publication in the Official Gazette dated 31.12.2022 and numbered 32060. With the Communiqué, the Communiqué on Environmental Impact Assessment Qualification Certificate published in the Official Gazette dated 29.11.2019 and numbered 30963 is repealed; principles regarding the institutions that will prepare files/reports under the Regulation on Environmental Impact Assessment are revised. Significant amendments introduced by the Communiqué are summarized below.

  • Institutions that receive environmental impact assessment qualification certificate (EIA Qualification Certificate) are obliged to provide a registered electronic mail (KEP) address and prepare a website.
  • The institution holding an EIA Qualification Certificate cannot provide services within the scope of the Communiqué to the project owner with the same tax number as the EIA Qualification Certificate holder.
  • Persons who serve as the management body, persons authorized to represent, or shareholders of the institution holding an EIA Qualification Certificate cannot provide services to project owners in which they serve in any title or in which they are a shareholder.
  • Additional provisions have been introduced regarding the assignment process, the positions and the scope of authority of the personnel to be assigned in the institution holding an EIA Competency Certificate.
