Ministry of Treasury and Finance Published an Announcement Regarding the Communiqué No. 2022-32/66 on Decree No. 32
Following the publication of The Communiqué No. 2022-32/66 Amending the Communiqué No. 2008-32/34 (“Communiqué No. 2008-32/34”) regarding the Decree No:32 on Protection of the Value of Turkish Currency (“Communiqué No. 2022-32/66”) in the Official Gazette dated 19 April 2022 and No. 31814; the Ministry of Treasury and Finance has published a public announcement (“Announcement”) to clarify various issues related to the Communiqué No. 2022-32/66 on 21 April 2022.
The explanations made in the Announcement may be listed as follows:
- For the performance of the sale of goods contracts which have been executed before 19 April 2022, it is not necessary to execute and accept the payment obligations within the scope of the foreign currency securities that have entered into circulation before the effective date of the Communiqué No. 2022-32/66 in Turkish currency.
- The term “movable” used in the Communiqué refers to all goods and assets that are not included within the scope of immovables.
- Checks and other similar instruments of payment in foreign currency that are issued on 19 April 2022, when the amendment entered into force, and after this date cannot be used as an instrument of payment for the execution of the payment obligations subject to the contracts on sale of goods except for contracts on vehicle sales executed or to be executed among the residents of Turkey.
- As per Article 8/18of the Communiqué it is possible to determine the obligations regarding the creation, issuance, trading and obligations regarding the transactions of capital market instruments (including foreign capital market instruments and depository receipts and foreign investment fund shares) in foreign currency within the scope of the Capital Market Law numbered 6362 and regulations made with respect to this law and the obligations related to those transactions are not covered by the amendment dated 19 April 2022.
