Communiqué Amending the Communiqué on the Printing Method of Checkbooks and Determination of the Amount that Banks are Obliged to Pay to the Bearer
The Communiqué (No: 2024/1) Amending the Communiqué (No: 2010/2) on the Printing Method of Checkbooks and Determination of the Amount that Banks are Obliged to Pay to the Bearer (Communiqué) was published in the Official Gazette dated 27.01.2024 and numbered 32442. The Communiqué enters into force on 31.01.2024 and amends the liability amounts that banks are obliged to pay for dishonored checks.
Under the Communiqué for each cheque leaf presented in due time, the addressee bank must pay to the bearer other than the presenting issuer:
- In case the check is fully dishonored; if the value of the check is TRY 9270 or more, TRY 9270; if the value of the check is less than TRY 9270, the value of the check,
- In case the check is partially dishonored; if the check value is TRY 9270 or less, an amount that will complete the partial provision to TRY 9270, provided that it does not exceed the check value; if the value of the check is over TRY 9270, TRY 9270 in addition to the partial provision, provided that it does not exceed the check value.
For the cheques printed by prior Communiqués than the Communiqué on the Printing of Cheque Books and Determination of the Amount Banks are Obliged to Pay to the Bearer (Number: 2010/2), the addressee bank is obliged to pay up to TRY 8650 for each cheque leaf in case the cheque presented within the due date is dishonored, and in case the cheque is partially dishonored, the addressee bank is obliged to pay this amount up to TRY 8650 for each cheque leaf.
