Public Announcement on the Use of the Revenue Administration’s E-Notification System for Serving Administrative Fines

The Personal Data Protection Authority (the Authority) has published a public announcement on the Use of the Revenue Administration's E-Notification System for Serving Administrative Fines (the Announcement) concerning the method of serving administrative fines imposed under Article 18 of the Personal Data Protection Law No. 6698 (the Law).

According to the Announcement, administrative fines will now be served through the E-Notification System of the Revenue Administration of the Ministry of Treasury and Finance, following the completion of a protocol between the Authority and the Ministry.

Key points outlined in the Announcement are summarized below:

  • The E-Notification infrastructure will be utilized in accordance with Article 107/A of the Tax Procedure Law No. 213.
  • Notifications sent through this system will be deemed to have been served on the fifth day following their delivery to the recipient’s electronic mail address.
  • For data controllers without a registered tax liability or whose registration has been cancelled, notifications will continue to be served pursuant to the Notification Law No. 7201.
  • Going forward, administrative fines imposed for breaches of the following obligations under Article 18 of the Law will be served via the E-Notification infrastructure:
  1. The obligation to inform data subjects,
  2. The obligation to ensure data security,
  3. Obligation to comply with the Personal Data Protection Board decisions,
  4. The obligation to register with and notify the Data Controllers’ Registry,
  5. Administrative fines imposed for violations of obligations such as the notification obligation set forth under Article 9 of the Law, 

shall be served to the relevant data controllers via the infrastructure of the Ministry of Treasury and Finance Revenue Administration’s E-Notification system.
