The Capital Markets Board Published an Announcement Regarding e-Application
The announcement (Announcement) under the Capital Markets Board (CMB) Decision No. 18/470 was published in the Capital Markets Board Bulletin dated 28.03.2024 and numbered 2024/17.
On 05.02.2024, it was announced that capital market institutions, organizations, and companies can submit their applications through the e-Application System. In this context, as of 15.04.2024, applications made to the CMB by issuers, institutions, and organizations falling within the scope of the Central Registration System and covered by the mandate of the Department of Company Finance shall be made electronically through the e-Application System.
In situations regulated under the "mandatory cases" stipulated in subparagraph (m) of Article 3 of the Public Disclosure Platform Communiqué No. VII-128.6, applications can be physically made with a wet signature. If the applicant companies, institutions, or organizations do not already have an electronic signature, they may physically apply with a wet signature until an electronic signature is provided. However, in any case, the officials of the companies, institutions, or organizations wishing to apply must obtain an electronic signature and notify the CMB that they have obtained an electronic signature before the application is finalized.
The points to be considered in the e-Application processes specified in the Announcement are summarized below:
- Identity and authorization controls are conducted in the e-Application.
- The application made through e-Application should be signed with an electronic signature at the last stage of the application.
- As soon as the application is submitted to the CMB, the application is reviewed by the relevant personnel. During the review process, the requested information and documents are sent to the relevant persons via e-mail.
- It is possible to view the CMB's requests, send messages and submit new documents via the e-Application application. After the deficiencies in the application are eliminated, the application must be signed electronically again with the updated documents and forwarded to the CMB.
- For the application to be finalized, it must be signed and submitted again after the amendments. Application status can be tracked via the e-Application.
