260 NEWSLETTER 2016 Conclusion With the introduction of TCO Article 66/3, a new type of respon- sibility, not previously identified in former laws, has been established. Along with the acceptance of the organizational liability as a type of absolute liability, a person who employs personnel at an organization operating as a business, shall not be excluded from liability solely by proving that he acted with due care in selecting, instructing and supervising. It must be proven that the organization was established correctly, as well.
