Administrative Fines under the Climate Law and the Environmental Law Updated for 2026
The Communiqué on Administrative Fines to Be Imposed Pursuant to the Climate Law No. 7552 (Communiqué No. 2026/1) and the Communiqué on Administrative Fines to Be Imposed Pursuant to Subparagraph (k) of the First Paragraph of Article 20 of Environmental Law No. 2872 (Communiqué No. 2025/41) have been published in the Official Gazette dated 27.12.2025 and numbered 33120.
With Communiqué No. 2026/1 and Communiqué No. 2025/41, the administrative fines to be imposed under the Climate Law and the Environmental Law have been re-determined by being increased at the revaluation rate of 25.49%, as determined for the year 2025.
The administrative fines to be imposed under the Climate Law between 1 January 2026 and 31 December 2026 are summarized below:
- TRY 627,450 to TRY 6,274,500 for failure to submit the verified greenhouse gas emission report within the prescribed period,
- TRY 150,588 to TRY 3,137,250 for violations of the procedures and principles, prohibitions or restrictions set forth under the legislation concerning ozone-depleting substances,
- TRY 150,588 to TRY 3,137,250 for violations of the procedures and principles, prohibitions or restrictions concerning fluorinated greenhouse gases,
- With respect to undertakings covered by the Emissions Trading System that operate without a greenhouse gas emission permit or continue their operations with an expired or revoked permit, TRY 6.2745 per ton of carbon dioxide equivalent emissions in cases where a verified annual greenhouse gas emission report is available; and TRY 1,254,900 to TRY 12,549,000 in cases where no such verified report is available,
- TRY 150,588 for failure to fulfill the obligation to register carbon credit generation projects in the carbon credit registry system within the period determined by the Directorate of Climate Change,
- TRY 213,333 for failure to comply with the prescribed obligations to provide information, documents, and data or for making misleading statements. In any event, the administrative fine to be imposed for each violation may not exceed TRY 62,745,000.
On the other hand, with Communiqué No. 2025/41, between 1 January 2026 and 31 December 2026, an administrative fine of TRY 699,245 shall be imposed under the Environmental Law in cases of damage to biological diversity or violations of the procedures and principles regarding the protection and use of wetlands, while an administrative fine of TRY 3,496,768 shall be imposed for violations of the prohibitions relating to the filling or drainage of wetland.
